Justice For All’s Save Uyghur Campaign Calls for U.S. Investigation into Entry of Former Chinese Official Linked to Uyghur Genocide

Washington, D.C. – Justice For All’s Save Uyghur Campaign has submitted a formal memorandum to the U.S. Department of State, with a copy to the Congressional-Executive Commission on China, urging a full investigation into how former Chinese official Xuan Guojun was able to enter and reside in the United States despite existing sanctions targeting perpetrators of the Uyghur genocide.

Xuan, who held senior positions in both the Urumqi Municipal People’s Congress and the Xinjiang Uyghur Autonomous Region (XUAR) People’s Congress between 1997 and 2012, played a legislative role in passing and enforcing repressive laws that underpin China’s ongoing genocide against Uyghurs and other Turkic peoples. These measures included forced sterilizations, coerced abortions, mass surveillance, and the criminalization of Uyghur cultural and religious expression.

Despite this record, Xuan was recently arrested in Arcadia, California, alongside his wife, after their two-month-old infant was hospitalized with a severe head injury. Law enforcement discovered 21 children in their care, prompting an FBI investigation into allegations of abuse, surrogacy-related misconduct, and possible child trafficking or organ harvesting. The couple’s business, Mark Surrogacy Investments LLC, is also under federal scrutiny.

“Allowing an individual complicit in the Uyghur genocide to live freely in the United States, while under sanctions frameworks like the Uyghur Human Rights Policy Act, the Global Magnitsky Act, and Section 7031(c),  is a dangerous failure of our immigration and national security systems,” said Imam Abdul Malik Mujahid, President of Justice For All. “The United States must not become a safe haven for those who commit mass atrocities abroad and exploit vulnerable people here at home.”

Xuan also holds leadership positions in multiple U.S.-based organizations tied to the Chinese Communist Party’s United Front Work Department, raising further concerns about CCP influence operations and monitoring of diaspora communities on American soil.

“This is not just a case about one man,” said Arslan Hidayat, Save Uyghur Team Lead. “It’s about ensuring that U.S. laws meant to hold war criminals and genocidaires accountable are actually enforced. If someone like Xuan can slip through the cracks, it signals to other perpetrators that America’s doors are still open to them.”

The memorandum asks the Department of State to work with the Department of Homeland Security, FBI, and other agencies to:

  • Determine how Xuan obtained entry and whether he misrepresented his background.
  • Investigate possible violations of sanctions and immigration laws tied to genocide and human rights abuses.
  • Assess the activities of CCP-linked groups operating in California under Xuan’s leadership.
  • Publicly reaffirm that U.S. soil will not harbor perpetrators of genocide or those involved in potential child exploitation.
